("you"and "user") are agreeing to the Terms of
Service, Privacy Policy, and Acceptable Use Policy as stated on this
and related sites and are bound by these terms regarding any activity

and non-refundable.

Types
of Services
Services
provided by us are
of both 'subscription' and 'one-time only' in nature depending on the
service(s) purchased. The following terms are applicable as stated:

Subscription Services - Subscription
services, such as membership to the site, are charged as recurring
subscriptions. It is the sole responsibility of the user to assure that
all criteria for subscription services have been met and that
subscription fees are paid. Failure to meet the criteria for
subscription services or make payment on subscription due dates may
result in cancellation of services and/or additional charges incurred
by us for failure on your part to make payment on or before the due
date.

One-time Only Services - One-time Only
services, such as chat room setup or similar service, are charged as
single transactions. It is the sole responsibility of the user to
assure that all criteria for these services are met at the time of
purchase and thereafter. Failure to meet the criteria for these
services may result in refusal of services or cancellation of services.
Site membership is required for the purchase of one-time only services
amd may be purchased in conjunction with one-time services.
Rates
of Services &
Notification
The user
acknowledges that
nature of
the furnished service and initial rates have been communicated to the
user prior to purchase for the purposes of payment. User
acknowledges and accepts that we may change service rates from time
to time. The user assumes sole responsibility for awareness of
service rates at the time of payment.
Failure
to Pay
Users
are
responsible
for keeping registration information up-to-date with us
in order to avoid cancellation of services should a problem arise
with the processing of payments. This includes current payment
processer (credit card or online account information) and active
email address. Cancellation of accounts or services will not relieve
users of the responsibility to pay any accrued charges, reasonable
interest, or collection fees.
Cancellation
of
Membership and/or
Services
All
cancellations of
membership
accounts or services must be done in writing and sent to: bdrunning@shaw.ca
and must
include the following information:

The email address used to register with the site and
the email address used to purchase services (if different from the
email used to register);

The reason for cancellation;

The desired date for the cancellation to take effect.
Cancellation
of
services
is
not complete until the user has received a Confirmation
of Cancellation email. Users are responsible for giving reasonable
notice of cancellation before a payment due date to avoid unnecessary
charges.
Technical
Support
Boundaries
We offer
technical support
for issues
resulting from the servers not functioning within the acceptable
established parameters. We do not offer technical support for the
following issues: browser incompatibility, third-party applications,
or software errors caused by the use of malicious code or scripts by
users.
Suspension
or
Cancellation of
Service
We
reserve the right to
suspend or
cancel services at any time without notification for any reason. Any
violation of site policies that results in additional costs to the
site (such as exceeding server space or transfer limitations) will be
billed to the user. Users will not be credited for any time that the
user account is suspended.
Indemnification
User
agrees
that
it shall defend, indemnify, save, and hold us harmless from any and
all demands, liabilities, losses, costs and claims, including
reasonable attorney's fees asserted against us, its agents, its
customers, officers and employees, that may arise or result from any
service provided or performed or agreed to be performed or any
product sold by customer, its agents, employees or assigns. User
agrees to defend, indemnify, and hold us harmless against liabilities
arising out of; (1) any injury to person or property caused by any
products sold or otherwise distributed in connection with our
services; (2) any material supplied by User's infringing or allegedly
infringing on the proprietary rights of a third party; (3) and
copyright infringement .
Disclaimer
We
make
no
warranties of any kind, expressed or implied for services we provide.
We disclaim any warranty or merchantability or fitness for a
particular purpose. This includes loss of data resulting from delays,
non-deliveries, wrong delivery, and any and all service interruptions
caused by the hosting company and its employees. User further
acknowledges that this site's liability for its own negligence may
not in any event exceed an amount equivalent to charges payable by
User for services during the period damages occurred. In no event
shall the company be liable for any special or consequential damages,
loss or injury.
Amendments
We reserve
the right to
revise our
policies and services at our discretion. If you do not agree with any
revision to the Agreement or change(s) in service(s), you may
terminate this Agreement and any purchased services by cancelling
your account using the procedure outlined above. You agree that by
not terminating your account following any revision to this Agreement
or the change(s) in service(s) that you shall be bound by any such
revisions and service changes.
